Terms & Conditions V1.03 Effective 2025-08-27

Company: CynoCentric, LLC.

Client: the person completing a booking or registration.

Dog: the Client’s dog.

Services: training classes, private lessons, neutral/helper dog sessions, facility/field rentals, workshops, and similar offerings.

1) Age and Authority

Client must be at least 18 years of age. If a minor (under 18) will be participating in Services, their parent or legal guardian must complete and sign this agreement as the Client. Client represents that they have full authority to make decisions regarding the Dog’s training and care. If multiple family members or handlers will attend sessions, Client is responsible for ensuring all attendees understand and comply with these Terms.

2) Assumption of Risk; No Guarantee

Client understands that working with dogs involves inherent risks to people, dogs, and property. Client assumes all risks arising from participation in the Services. Company does not guarantee specific training results or outcomes.

3) Release & Indemnification

Consideration. In consideration of being permitted to enroll in and participate in the Services, to access Company facilities and equipment, and to receive training instruction (collectively, the “Consideration”), Client agrees to the release and indemnity below. This Consideration is independent of any fees paid and remains sufficient even if a session is complimentary or fees are later refunded.

To the fullest extent permitted by law, Client releases and agrees to defend, indemnify, and hold harmless the Company and its owners, employees, contractors, volunteers, and property owners from claims, losses, or expenses (including reasonable attorneys’ fees) arising out of Client’s participation in the Services or Client’s Dog, except to the extent caused by Company’s gross negligence or willful misconduct.

4) Safety Rules

  1. Client must maintain control of the Dog at all times; use a leash, crate, or tether as instructed.
  2. No dog-to-dog greetings without the Trainer’s explicit permission.
  3. Do not transfer the leash to anyone unless requested by the Trainer and only with Client consent.
  4. Do not feed any dog other than your own unless specifically instructed.
  5. Use secure, humane equipment (front-attach harness, flat buckle or martingale collar, head halter, etc.). If additional control is needed, discuss with the Trainer before class.

5) Health Requirements & Behavioral Disclosure

  1. Dog must be under a veterinarian’s care and current on rabies and core vaccinations as required by law; documented vet exceptions are accepted where appropriate.
  2. Do not attend if Dog shows signs of illness (vomiting, diarrhea, coughing, fever, eye/nasal discharge, lethargy) or has fleas/contagious parasites.
  3. Company may require veterinary clearance before Dog returns after illness/injury.
  4. Behavioral Disclosure: Client must disclose any known behavioral issues, bite history, aggression incidents, or prior training challenges before the first session, and must follow trainer-directed management plans (e.g., muzzle use, equipment changes, spacing). Failure to disclose known issues or to follow required management may result in immediate dismissal without refund.

6) Cancellations, Makeups & Missed Sessions

Applies to all Services:

  • > 48 hours before the scheduled start: full refund minus 25% cancellation fee, or one reschedule at no penalty.
  • Within 48 hours: no refunds; reschedules only at Company’s discretion for exceptional circumstances.
  • Rolling-enrollment classes: comparable makeups generally offered; discuss options with staff.
  • Limited series: no makeups; an alternate drop-in may be offered at Company discretion.
  • All makeups must be scheduled through staff, are subject to availability, and must be completed within 14 days of the current training term.
  • No-shows: missed sessions without prior notice are treated as used.

7) Inclement Weather & Safety

CynoCentric may pause or cancel sessions for inclement weather and any other potentially unsafe conditions, including (without limitation) a Level 2–3 snow emergency at the facility or along primary routes at the start time, lightning for outdoor work, extreme heat/cold, ice, power/HVAC failure, or unsafe footing.

If we cancel: you receive a no-penalty reschedule or account credit. If we remain open but your home or route is under Level 2–3 at start time, notify us before the session for one no-penalty reschedule within 14 days (space-available).

This section controls over §6 in case of conflict.

8) Payments & Refunds

  • Payment is due at booking; registrations are confirmed once payment is received.
  • Approved refunds are processed to the original method within 14 business days.
  • Client agrees to contact Company to resolve any issue before initiating a chargeback. Company will contest chargebacks for attended or otherwise used Services.

9) Incidents & Medical Care

  • Client will promptly report any incident (bite, injury, property damage) and cooperate with documentation.
  • Client authorizes Company to provide reasonable first aid and, if needed, to seek emergency veterinary or medical care. Client is financially responsible for such costs.
  • In the event of a bite, Client will provide current rabies documentation and comply with public health requirements.

10) Dismissal

Company may remove Dog/Client from a session or dismiss from Services for safety risks, persistent rule violations, disruptive or aggressive handler behavior, or failure to meet health/payment requirements. No refunds are provided for dismissal under this section.

11) Facility & Rentals

Clients using the training building or field agree to follow posted rules, respect equipment and boundaries, and vacate on time. Client is responsible for damage caused by themselves or their Dog beyond normal wear and tear from appropriate use.

  • Client must promptly clean up after their Dog (indoors and outdoors). Waste bags and bins are provided.
  • Do not move or use equipment in ways not instructed; repair or replacement costs may be charged for damage beyond normal wear.

12) Intellectual Property

All training materials, handouts, videos, and online resources provided by Company remain Company’s intellectual property. Client receives a non-exclusive, non-transferable license to use these materials for personal training purposes only; any reproduction, distribution, or commercial use requires written permission.

12A) Recording

Recording (audio or video) during sessions is not permitted without prior permission. Company training materials and videos remain Company’s intellectual property.

13) Electronic Signatures & Acceptance

By submitting a registration or booking form and selecting the “Accept Terms” checkbox (I have read and agree to the Terms & Conditions), Client consents to transact electronically and agrees that such selection constitutes Client’s legal signature to these Terms & Conditions.

14) Changes; Severability; Governing Law

  • Company may update these Terms for future bookings by posting a new version; prior versions remain applicable to earlier bookings.
  • If any provision is found unenforceable, the remainder remains in effect.
  • These Terms are governed by the laws of the State of Ohio. Exclusive venue and jurisdiction lie in the state or federal courts located in Franklin County, Ohio.

15) Force Majeure

Neither party is liable for delay or failure to perform due to events beyond reasonable control (including severe weather, power/utility outages, fire, flood, epidemic, government action, or labor disruptions). Company may reschedule or credit affected sessions.

16) Data & Privacy

When you register or book, we collect the information you submit (e.g., name, contact details, Dog information, session choices) and basic technical data such as your IP address, browser/user-agent, page URL, and timestamps. We use this to process bookings, provide Services, prevent fraud/abuse, troubleshoot, and meet legal/record-keeping obligations.

  • Storage & Sharing. Data is stored in our website/form records and related systems (e.g., email, payments, scheduling). We do not sell personal data. We may share with service providers who process data for us under contract, and as required by law.
  • Retention. We retain registration records for as long as needed for Services and compliance; typically 24 months after your last activity, and longer where required for financial/legal records.
  • Your choices. To request a copy or deletion of your form record (where legally permitted), contact us. Some records cannot be deleted while legal, safety, or accounting obligations apply.
